GENERAL CONDITIONS OF ONLINE SALES WITH PAYMENT GATEWAY FOR THE PURCHASE OF SERVICES

GENERAL INFORMATION

These General Conditions of Online Purchase (hereinafter, "the General Conditions") are established for the purpose of regulating the contractual relationship that arises between the owner of www.camarabelarus.com (hereinafter, "website") and the user (hereinafter referred to, indistinctly, individually as "Client" or jointly as "Clients"), with respect to the acquisition and/or electronic contracting of the services offered through this website.

The General Terms and Conditions are intended exclusively for consumers. According to article 3 of Royal Legislative Decree 1/2007 of 16 November, General Law for the Protection of Consumers and Users, a consumer is defined as any natural person who acts for purposes beyond his trade, business, craft or profession, as well as legal persons and organisations acting on a non-commercial basis in a field that goes beyond trade or business. Thus, the purchase of services carried out by companies or individual professionals would not be covered by this law and, consequently, some of the prescriptions of the General Conditions would not apply to them.

The Client must read and accept these General Conditions prior to purchase, as well as having read the Legal Notice, the Privacy Policy and the Cookies Policy in force before accessing, browsing and/or using this website. The terms and conditions applicable to the purchase of the services offered to the public on this website will be all those described in these General Conditions and which will be detailed during the online purchase process.

The Client is informed that the General Conditions may be modified at any time, with those in force when the purchase or contracting of services is made being applicable. For this reason, we recommend that you read them every time you access, browse and/or use the website.

These General Conditions have been drawn up for consumers, in accordance with the provisions of Law 34/2002, of 11 July, on Information Society Services and Electronic Commerce, Law 7/1998 on General Contracting Conditions, Royal Legislative Decree 1/2007, of 16 November, approving the Revised Text of the General Law for the Defence of Consumers and Users and other complementary laws, and Law 7/1996, of 15 January, on the Regulation of Retail Trade.

The website is intended for users resident in Spain. It is not guaranteed that the website complies with the legislation of other countries, either totally or partially. If the Client resides or is domiciled in any place other than Spain, and decides to access and/or browse the website, he/she does so at his/her own risk and responsibility, and must ensure that such access and/or browsing complies with the local legislation applicable in his/her case.

USE OF THE WEBSITE

Any individual or legal entity that accesses and browses this website shall be considered a user. Access to the website, and the use of the materials contained therein for the contracting of the services offered, implies that the user has read, knows and accepts, without reservation, these General Conditions. Likewise, by using this website, the user agrees to be bound by the applicable General Conditions of Web Use. If the user does not agree with them, he/she should not use the website.

The user undertakes to use the website responsibly when accessing, browsing and making use of the website. As an example, but not limited to, the responsibility extends to:

Use the website for the sole purpose of making enquiries and, where appropriate, contracting the services offered in a legally valid manner.

Do not place any false or fraudulent order. The owner of the website, as well as the entities that manage the online payment methods, have the power to cancel the contract if they detect that it is false or fraudulent, and may inform the competent authorities of such circumstances.

Guarantee that the data provided to complete the purchase are true, accurate, exact, complete and up to date, the Client being responsible for any direct or indirect damage that may arise from this non-compliance. In accordance with the data provided, the Client consents to any communication relating to the services purchased, necessary for the maintenance of the commercial relationship.

The Client may, at his/her choice, formalise the contracting of the desired services in any of the languages in which these General Conditions are available at any given time.

RECRUITMENT PROCESS AND PROCEDURE

Through this website we offer the sale of services necessary to provide our members and partners with the necessary tools to help grow their business between Belarus and Spain.

The Belarus Chamber of Commerce & Industry Spain will publish the specific characteristics and the applicable selling price of each service.

To place an order, you must go through the online purchasing procedure via the relevant payment gateway, by selecting the service and, if applicable, the quantity, and registering and providing the following information:

Name and surname

TAX ID NUMBER

Domicile / Address in Spain

Current account number

Bank card number, card holder, expiry date and security code

E-mail address

Paypal (if available)

Mandatory confirmation windows may be displayed in various sections during the purchase process, which will not allow the order to proceed if the details have not been provided correctly. During the process and before its completion, the Customer may modify the details of the services that have been added in the purchase, their personal data or any other information that has been displayed on the screen, including the information displayed by the payment gateway. The purchase will be definitively completed by clicking on the Subscribe button.

Once the purchase has been made, Belarus Chamber of Commerce & Industry Spain will send confirmation of the order by e-mail to the address provided by the Client, within a maximum period of 24 hours, detailing the services purchased, the costs, taxes, the method of payment, and the deadline and method of completion. In the event that the Client detects an error in his/her order after the payment process has been completed, he/she should immediately contact the Customer Service Department, via the contact telephone number or e-mail address.

The Customer consents, by confirming the purchase, that the owner of the website may generate an electronic invoice, at no additional charge, which may be sent to the Customer by e-mail or in paper format, if the Customer so requests.

Belarus Chamber of Commerce & Industry Spain will keep all personal data, communications, purchase orders and payments in relation to all transactions carried out on the website, information that will be kept and stored in the corresponding files and computerised records of the company for the legally established periods, in order to constitute a means of proof of contracting, guarantee the correct execution of the commercial relationship, as well as to comply with the rest of the legal obligations. All of this will be carried out by adopting the security measures indicated in the website's Privacy Policy and necessary in compliance with Regulation (EU) 2016/679 of the European Parliament and of the Council, of 27 April 2016, on the protection of natural persons with regard to the processing of personal data and the free movement of such data, and Organic Law 3/2018, of 5 December, on the Protection of Personal Data and guarantee of digital rights.

AVAILABILITY

All orders are subject to the actual availability of the service. In the event of difficulties in the provision of services, the Customer will be reimbursed for any amount paid.

PRICE AND PAYMENT METHOD

All prices indicated on the website are in Euros and include VAT and any other taxes that may apply in accordance with current legislation, without prejudice to the specific regulations that may apply to taxation in the Canary Islands, Ceuta and Melilla.

Before confirming the purchase by clicking on the corresponding button, the Client will be able to know the final price of their order, and if applicable, the amount of any increases or discounts that may be applied, as well as the costs of any additional services contracted. Payment methods other than those described above will not be accepted. The Belarus Chamber of Commerce & Industry Spain shall not be liable for the non-tracing of payment or any other type of damage caused to the Customer in the event that payment has been attempted through an unauthorised method.

Belarus Chamber of Commerce & Industry Spain reserves the right to modify its prices at any time, and therefore guarantees that the price of the services will be the price in force at the time of the formalisation of the purchase, regardless of the day on which the order is delivered.

The owner of the website uses an SSL certificate as a global security standard that allows the transfer of encrypted data between the user's browser and the merchant's web server. Likewise, under no circumstances are the customer's card details captured or stored during the purchase process.

Likewise, for customer security, the electronic payment system has been entrusted to a virtual payment gateway, which uses the 3D-Secure programme, created by Visa (Verified by Visa) and Mastercard (Mastercard Secure Code), to authenticate cardholders and obtain an additional level of protection against fraud. The bank details entered are encrypted and securely transmitted to the servers of the entity that manages the gateway and are subsequently verified with the issuing bank to prevent possible fraud and abuse, so that no third party will have access to this information relating to the bank details entered by the Customer.

The payment service provider is PCI DSS certified (https://www.pcisecuritystandards.org/), guaranteeing the implementation of a series of best practices in payment processing that guarantee compliance with this standard.

By virtue of the above, the website owner declares that the payment service provider operates and guarantees the transaction through a system of double user authentication (SCA: Strong Customer Authentication), as well as having secure communication protocols and networks, in compliance with the provisions of Royal Decree-Law 19/2018, of 23 November, on payment services and other urgent measures in financial matters.

TERM OF VALIDITY OF DISCOUNTS

In the event of applicable discounts on the price of the services, these shall be indicated next to the initial price in a different font that allows the Client to clearly identify the final price of the service. In any case, the period during which the discount is valid shall be indicated.

SERVICE PERFORMANCE

The placement of the order and its confirmation by the customer, materialize the full and complete acceptance of these terms and conditions of sale. The provider will carry out the execution of the service, complying with the terms and conditions agreed in the order. The provider undertakes to keep the client informed at all times about the execution of the service and any incidents that may arise during the same.

Belarus Chamber of Commerce & Industry Spain undertakes to execute the order without undue delay and at the latest within a maximum of seven calendar days from the conclusion of the contract.

LIMITS OF LIABILITY FOR SERVICE PROVISION

Belarus Chamber of Commerce & Industry Spain, as the service provider, will make its best efforts to provide the service in the best conditions for the client, guaranteeing that the service is provided fairly and in good faith. However, the client understands and accepts that certain technical difficulties and other factors beyond the provider's control may cause temporary interruptions to the services, and the provider shall not assume any liability arising from these interruptions, and the client therefore expressly exempts the provider from any liability related to the performance of the services, and in a non-exclusive manner in the following cases:

Force majeure or any other circumstances beyond the activity or control of the provider.

Those cases relating to security attributable to the user himself/herself, such as the loss of his/her access or identification data, access by unauthorised third parties, errors in data entry, damage caused by the use of insecure software, errors or malfunctioning of technological tools, etc.

Damage caused by unlawful or fraudulent use in violation of these terms and conditions.

WITHDRAWAL

Given the nature and characteristics of the services offered on this site, the right of withdrawal may not be exercised, by virtue of Article 103 of Royal Legislative Decree 1/2007, of 16 November, which approves the text of the General Law on the Protection of Consumers and Users and of other complementary laws, and states that the right of withdrawal will not apply in the following cases:

When the service has been fully performed, when the performance has begun, with the prior express consent of the consumer and with the consumer's acknowledgement that he knows that he loses his right to withdraw from the contract once the contract has been fully performed.

For the provision of accommodation services for purposes other than housing, transportation of goods, car rental, catering or leisure services, if the contracts provide for a specific date or period of performance.

When providing services whose price depends on fluctuations in the financial market that the entrepreneur has no control over and which may occur during the withdrawal period.

In all other circumstances not exempted by law, the buyer shall have the right to withdraw from the contract within 0 calendar days of signing the contract without giving any reason and without incurring any costs.

In order to cancel the purchase and before the service period begins, the Customer must send a written notification to the Belarus Chamber of Commerce Spain, clearly informing them of the use of the right of withdrawal, to the following email address: camara@camarabelarus.com. The notification must include the full name and identification number / ID card.

In the event that the right of withdrawal is exercised correctly, Belarus Chamber of Commerce & Industry Spain will reimburse the Customer all payments received, without delay and within 14 calendar days from the date on which the Customer was informed of the decision to withdraw. The refund will be made using the same means of payment used by the Customer for the purchase, without incurring any additional costs.

WARRANTIES

If at the time of delivery to the Client by Belarus Chamber of Commerce & Industry Spain, the service is defective or does not conform to the description provided by the seller, nor is it suitable for its intended use or of the expected quality, the Client may request the repair or replacement of the service, unless one of the two options is objectively impossible or disproportionate in accordance with the applicable legislation. Repair and replacement shall be free of charge for the Customer and shall be carried out within a reasonable period of time, taking into account the nature of the services and the purpose for which they were intended.

In the event that repair or replacement of the service is not possible, in accordance with the regulations in force, the Customer may choose between (i) requesting a price reduction or (ii) terminating the contract, unless the lack of conformity is of minor importance.

In accordance with article 123.1 of the General Law for the Defence of Consumers and Users, Belarus Chamber of Commerce & Industry Spain shall be liable for any lack of conformity that becomes apparent within two years of delivery, provided that the lack of conformity existed at the time of delivery of the service. The Client must inform Belarus Chamber of Commerce & Industry Spain of the existence of the aforementioned lack of conformity within two months of becoming aware of it.

EXEMPTION FROM LIABILITY

The website services are provided on an "as offered" and "as available" basis and cannot be guaranteed to be suitable for the Customer's particular purposes and needs.

Except as otherwise provided by law, Belarus Chamber of Commerce & Industry Spain hereby expressly excludes all liability for (i) losses not attributable to any breach by the Seller, (ii) business losses (including loss of profits), (iii) technical failures due to fortuitous or other causes that prevent normal operation of the website via the Internet or unavailability of the services, (iv) any failure or delay in the performance of any of its obligations beyond its reasonable control, i.e. justified by force majeure (including but not limited to strikes, lockouts, third party system or network failures, fire, natural disasters or deliberate sabotage).

In such cases, any time limit obligations that may exist shall be suspended for the entire period during which the situation of force majeure or fortuitous event is prolonged, and the calculation shall be resumed once this circumstance has ceased to exist.

COMPLAINTS AND CLAIMS

Customers may send their complaints, claims or any other comments by e-mail to camara@camarabelarus.com or by post to the address given in the heading of this web page.

In addition, the owner of the website has official complaint forms available to contracting parties and Customers, which they may request at any time, using the aforementioned contact details.

The owner of the website will respond to your request as soon as possible and, in any case, within a maximum period of one month. In the event that the Client's request is not satisfactorily resolved, he/she may appeal to the courts and tribunals indicated in the corresponding section.

Customers are also informed that, in compliance with Article 14.1 of EU Regulation 524/2013, consumers established in the European Union may submit their complaints or disputes through the European Commission's online dispute resolution platform, available through the following link: http://ec.europa.eu/consumers/odr/.

INDUSTRIAL AND INTELLECTUAL PROPERTY

The Client acknowledges and consents that all copyright, trademark and other industrial and intellectual property rights on the materials or contents provided as part of the website belong to Belarus Chamber of Commerce & Industry Spain at all times, as also indicated in the Legal Notice and the General Conditions of Web Use. The Client may make use of such material only in the manner authorised by the owner of the site. This shall not prevent the use of this website to the extent necessary to copy order information or contact details.

PERSONAL DATA PROTECTION

The information or personal data provided by Clients will be treated in accordance with the provisions of the Privacy Policy. It is reported that the owner of the website has adopted the technical and organizational measures necessary to guarantee the security, integrity and confidentiality of said personal data, in accordance with the applicable regulations on the protection of personal data.

APPLICABLE LAW AND JURISDICTION

This agreements is governed by the laws in force in Spain. For the resolution of any dispute that may arise between the parties, the judges and courts of the consumer's place of residence will be deemed competent.
